TABLE OF CONTENTS

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • names
  • phone numbers
  • email addresses
  • passwords
  • contact or authentication data
  • event information, including any and all information imported from external sources, such as Google services
  • time zone
  • contact preferences

We do not collect or store your payment card numbers. Payment card details and billing information are collected and stored directly by our payment processor, Stripe, as described under "Payment Data" below.

Sensitive Information. We do not request or intentionally collect sensitive personal information, and we ask that you do not include it in your event content. However, we do process certain information that may be considered sensitive under applicable law: (a) we process your account login credentials (such as your password) solely to authenticate you and secure your account; and (b) the content of events you create or import from third-party calendar providers (such as Google Calendar) may contain personal information — including information about you or others — that you or the original event creator chose to include in event names, descriptions, or other fields. We process such event content solely to provide the Services, such as displaying your events and delivering the reminders you configure.

Payment Data.If you choose to make purchases, your payment data (such as your payment instrument number and the security code associated with your payment instrument) is collected, handled, and stored directly by our payment processor, Stripe — it is not collected or stored by us. You may find Stripe's privacy notice here: https://stripe.com/privacy.

Third-Party Login Data.We provide you with the option to register and sign in using a third-party account, such as your Google account. If you choose to register in this way, we will collect certain profile information about you from that provider (such as your name and email address), as described in the section called "HOW DO WE HANDLE YOUR SOCIAL LOGINS?" below.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, time zone, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes:

  • Log and Usage Data.Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  • Time Zone Data. We collect your time zone (for example, based on your device or account settings) so that we can schedule and deliver reminders and display event times correctly. We do not collect GPS or other precise geolocation data.

Google User Data

Google sign-in.If you sign up or sign in with Google, we receive basic profile information from your Google account — such as your name, email address, and profile picture — which we use to create and manage your account, as described in "HOW DO WE HANDLE YOUR SOCIAL LOGINS?" Signing in with Google does not give us access to your Google Calendar; calendar access is requested separately, as described below.

Google Calendar. If you choose to connect your Google Calendar, we request read-only access to your Google Calendar data (the Google calendar.readonly scope). With your permission, we access and store event data — such as event titles, dates and times, recurrence information, and descriptions — from the calendars you select, along with the list of calendars on your account and OAuth tokens used to maintain the connection. We use this data solely to display your events within the Services and to deliver the reminders you configure. We do not edit, create, or delete events in your Google Calendar.

We do not sell Google user data (including sign-in profile information and calendar data), use it for advertising, or share it with third parties except with the service providers that process it on our behalf to operate the Services (as described in "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?"), and we do not allow humans to read this data except with your explicit permission (for example, to provide support you request), where necessary for security purposes, or where required by law.

You can disconnect your Google Calendar at any time from within the Services, or revoke our access through your Google account security settings at https://myaccount.google.com/permissions. When you unsubscribe a calendar within the Services, we stop syncing it and delete the events imported from it. If you revoke our access through Google, our stored credentials become unusable and syncing stops. Stored Google credentials and any remaining imported data are deleted when your account is deleted or upon your request, as described in "HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?"

Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
  • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
  • To request feedback. We may process your information when necessary to request feedback and to contact you about your use of our Services.
  • To send you marketing and promotional communications. We may process the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt out of our marketing emails at any time. For more information, see "WHAT ARE YOUR PRIVACY RIGHTS?" below.
  • To evaluate and improve our Services, products, marketing, and your experience. We may process your information when we believe it is necessary to identify usage trends, determine the effectiveness of our promotional campaigns, and to evaluate and improve our Services, products, marketing, and your experience.
  • To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.
  • To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

We may need to share your personal information in the following situations:

  • Vendors and Service Providers. We may share your information with third-party vendors, service providers, and contractors who perform services for us or on our behalf and need access to such information to do that work, pursuant to written contracts. These currently include our hosting and database provider (Supabase), payment processor (Stripe), SMS delivery provider (Twilio), email delivery provider (Resend), website hosting and analytics provider (Vercel), and calendar integration provider (Google), and may include similar providers we engage in the future. These providers are only permitted to use your information as necessary to provide these services to us.
  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Legal Obligations. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, or to protect our rights, property, or safety, or that of others.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We use a limited set of essential cookies and privacy-focused, cookieless analytics. We do not use cookies for advertising, and we do not sell or share your information.

We use a limited set of cookies and similar technologies that are necessary to operate the Services — for example, to keep you signed in, remember your preferences, maintain the security of your account, prevent crashes, and fix bugs. These are first-party and essential to core functionality.

We also use privacy-focused, cookieless analytics provided by Vercel (Vercel Web Analytics and Speed Insights) to understand aggregate usage and measure the performance of the Services. These tools do not use cookies, do not store your IP address, do not track you across other websites, and do not collect information that personally identifies you. You can review Vercel's privacy practices at https://vercel.com/legal/privacy-policy.

We do not use cookies or other tracking technologies for targeted advertising, and we do not sell or share your personal information. Most web browsers are set to accept cookies by default; you can usually set your browser to remove or reject cookies, though some features of the Services may not function properly as a result.

5. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using a third-party account, such as your Google account. Where you choose to do this, we will receive certain profile information about you from the provider. The profile information we receive typically includes your name and email address, along with any other information you have authorized the provider to share.

We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by the third-party login provider. We recommend that you review the provider's privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law. Records of your consent are kept for 5 years after they stop being in effect, including after your account is deleted.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). In general, we retain your personal information for as long as you maintain an account with us and for as long as reasonably necessary thereafter.

If your subscription ends and you do not reactivate it, your account stays read-only for 60 days, during which your information is kept so that you can pick up where you left off. If you do not reactivate within those 60 days, we delete your account and the information in it. We keep the billing record held by our payment processor, Stripe, after the account is deleted. It is used to process refunds and chargebacks, to meet financial record-keeping obligations, and to prevent fraud and repeated use of free trials, including by recognizing a returning customer by their email address.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from further processing until deletion is possible.

Records of your consent are the exception. When you accept our Terms and this Privacy Notice, or opt in to receive text messages, we keep a record of it: your email address (and, for text messages, your phone number), the date and time, your IP address, your browser or device information, the version and exact wording you agreed to, and any later opt-out. We keep each record while the consent is in effect and for 5 years after it ends: for text messages, 5 years after you verify a different phone number or delete your account; for our Terms and this Privacy Notice, 5 years after you delete your account. That period covers the time in which legal claims about the consent can be brought, and we keep the record so that we can show the consent was given and comply with the laws that govern it, including text-messaging rules. We do not use these records for any other purpose, and we delete them automatically when the period ends, or sooner where the law requires it, including as described in Section 8.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. The Services are intended only for users who are at least 18 years of age, and by using the Services, you represent that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records, including the records of consent we would otherwise keep (see Section 6). If you become aware of any data we may have collected from children under age 18, please contact us at info@wouldntmissit.com.

9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent:

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by adjusting the relevant settings in your account (for example, your notification and communication preferences) or by contacting us using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications:

You can unsubscribe from our marketing and promotional emails at any time by clicking on the unsubscribe link in the emails that we send, changing your user preferences, or by contacting us using the details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Our SMS messages are transactional reminders that you configure — we do not send marketing SMS. You can stop receiving SMS messages at any time by replying "STOP" to any message we send or by updating your notification preferences in your account settings.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted.

All the above categories exclude text messaging originator opt-in data and consent; this information won’t be shared with any third parties.

Account Information

If you would at any time like to review or change the information in your account, you can log in to your account settings and update your user account, or contact us using the contact information provided. If you would like to terminate your account and delete your data, you can:

  • Email us at info@wouldntmissit.com from the email address associated with your account and request account deletion; or
  • Use the "Delete account" option on your profile page, available at any time while signed in.

Upon your request to terminate your account, we will delete your account and information from our active databases immediately, except for the records of your consent described in Section 6, which we keep for the period stated there, and any billing records our payment processor retains. We may also retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Cookies and similar technologies:

Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services.

If you have questions or comments about your privacy rights, you may email us at info@wouldntmissit.com.

10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

11. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law.
